1. General Responsibilities

Wildseeker Safaris (“Wildseeker”, “we”, “our”) is a Destination Management Company (DMC) registered in Mauritius. We act as an agent between you (the “traveller”) and third-party suppliers such as lodges, camps, hotels, transfer providers, charter companies, and other service providers. Your contract for travel services is directly with those providers. Wildseeker is not liable for the acts or omissions of third parties. We curate and coordinate your safari but do not own or control the accommodation, activities, transport, or other services you may book.

Travel in Africa, especially in remote wilderness areas, carries inherent risks. Wildlife is free and unpredictable, weather conditions vary, and local infrastructure may be limited. By booking with Wildseeker, you acknowledge these risks and agree to participate at your own discretion.

While every effort is made to ensure the accuracy of descriptions, itineraries and prices on our website and marketing materials, Wildseeker cannot guarantee that wildlife sightings, specific facilities or services will be available as described, and minor variations shall not constitute a material change or grounds for cancellation without charges.

2. Documentation & Traveller Responsibilities

It is your responsibility to:

– Ensure all travellers (including children and infants) hold valid passports with at least 6 months’ validity after the end of the journey and sufficient blank pages.
– Obtain necessary visas and comply with health/vaccination requirements for the countries visited.
– Hold comprehensive travel insurance from the time of booking that covers medical expenses, evacuation, cancellation, curtailment, baggage loss, and other personal risks.
– Reconfirm flights and check for schedule changes directly with airlines before travel.

3. Pricing & Payment

– All prices are quoted in USD unless otherwise stated.
– Quotes are subject to change until confirmed in writing.
– Availability of services is not guaranteed until confirmed and deposit received.
– A non-refundable deposit (typically 30% of the total cost, or higher if required by suppliers) is due at confirmation.
– Full balance is due 60 days before travel unless otherwise stated on your invoice.
– Payments must be made via international bank transfer or credit card to our nominated account. All bank/credit card charges are the responsibility of the traveller.

If the balance payment is not received by the due date, Wildseeker reserves the right to treat the booking as cancelled and apply the relevant cancellation charges.

4. Amendments & Cancellations

– Amendments requested after booking may incur additional costs, payable immediately.
– Cancellations must be received in writing and are subject to the following standard charges unless otherwise specified by suppliers:
• 91+ days before travel: deposit retained
• 61–90 days before travel: 25% of total cost
• 31–60 days before travel: 50% of total cost
• 0–30 days before travel: 100% of total cost
– Some items, such as gorilla permits or restricted airline tickets, are strictly non-refundable.
– No refunds for unused services, missed activities, or early departure.

Please note that third-party suppliers (lodges, airlines, permits, etc.) may impose stricter cancellation or amendment terms than those set out above. In such cases, the supplier’s terms will prevail, and any additional charges will be payable by the traveller.

5. Insurance

Travel insurance is mandatory. It is the traveller’s responsibility to arrange suitable cover. Wildseeker is not liable for costs arising from lack of insurance coverage.

6. Not Included in Prices

Unless expressly stated in your itinerary, the following are not included:
– International and regional commercial flights
– Visas, passport costs, inoculations
– Travel insurance
– Tips, gratuities, and personal expenses (e.g. drinks, laundry, telephone calls)
– Meals not specified in the itinerary
– Optional activities not booked in advance
– Airport departure taxes unless indicated

7. Force Majeure & Service Variations

Wildseeker is not responsible for changes, delays, or cancellations caused by events beyond our control, including weather, strikes, political unrest, natural disasters, pandemics, or supplier failure. Service timings (e.g. flights, transfers, activities) in Africa can be variable and subject to change.

8. Health & Fitness

Safaris may involve long drives on rough terrain, walking on uneven ground, and exposure to wildlife. Travellers must be in reasonably good health and disclose any relevant medical conditions. Wildseeker may decline to accept a booking if participation would be unsafe.

9. Liability

To the fullest extent permitted by law, Wildseeker shall not be liable for any loss, damage, injury, accident, delay or irregularity arising from the acts or omissions of third-party service providers. Wildseeker’s total liability for any claim howsoever arising shall be limited to the amount actually received by Wildseeker from the traveller in respect of the relevant booking. Wildseeker shall not in any event be liable for indirect, consequential, or special losses including loss of enjoyment, profit or opportunity.

10. Baggage

Light aircraft flights have strict baggage restrictions (usually soft bags, max 15–20kg including hand luggage). Excess baggage may result in denied boarding or extra costs. Wildseeker is not responsible for loss, theft, or damage to luggage.

11. Data Protection

Wildseeker Safaris complies with the Mauritian Data Protection Act 2017 and any applicable international data protection laws. Travellers have the right to request access to, correction of, or deletion of their personal data held by Wildseeker. Personal data will only be shared with suppliers as necessary to fulfil bookings and will not be used for unrelated marketing without consent.

12. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of Mauritius. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mauritius.

– Wildseeker Safaris arranges your safari in partnership with trusted lodges, camps, and guides. We do not own these services and are not responsible for their actions.
– You are responsible for passports, visas, vaccinations, and having valid travel insurance from the time of booking.
– A deposit (usually 30%) confirms your booking, with the balance due 60 days before travel. Bank or card fees are your responsibility.
– Cancellations: deposits are non-refundable; cancellation penalties increase closer to departure.
– Insurance is essential – it should cover cancellation, medical, evacuation, and baggage.
– Prices exclude international flights, regional commercial flights, visas, tips, drinks, laundry, and optional extras unless clearly stated.
– Safari timings and conditions may vary due to weather, wildlife, and local infrastructure. Flexibility is essential.
– Safaris can be physically demanding; you should be in good health.
– Baggage on light aircraft is restricted (usually 15–20kg in soft bags).
– Your data is used only to arrange your trip. We respect your privacy.
– These Terms are governed by Mauritian law.
